How does it all work?
You provide details of your debts to our legal team who will then audit your credit agreements to establish whether these are enforceable or not. If the solicitors subsequently consider them to be invalid, unenforceable or fundamentally flawed, the agreements will be challenged with your creditors and a debt claim filed on your behalf to request that they verify the legality of the contract. As the creditors will not be able to confirm this, the solicitors can then, through a series of specific procedures, prove that your agreement is invalid and therefore unenforceable. They can then apply for the debt to be written off and if applicable, re-claim charges, interest and previous payments.
If it is considered that the agreements are not invalid, unenforceable or flawed, there is no cost to you for this service.
Do I need to provide copies of the Agreements?
It does not matter if you have lost or mis-placed documents as the solicitors will request original copies from your lender or card provider.
How long will it take?
This mainly depends on the speed at which you take to provide us with any information that we need, the creditors and their response times to our requests for information and confirmation that the debt has been written off. The initial audit normally takes up to 2 weeks and on average, the full claim procedure takes anywhere between five to nine months to accomplish. You will be kept informed periodically of the progress of your claim.
How much does it cost?
Audit Fee - Credit / Store Cards and Credit Agreements: £395 for first one then £95 for any subsequent ones (if submitted simultaneously).
HP and Secured & Unsecured Loan Agreements: £395 per Agreement.
Success Fee - 10% of amount recovered - limit of £1,000 per claimant. (Note: Other companies charge up to 30% with no maximum!)
An example of costs: 2 Credit Cards with a joint outstanding debt of £12,000 (£6,000 on each card) which is ultimately written off. Less total fees: £1,490 (£395 + £95 + £1000) Saving to client: £10,510.
Are there any adverse repercussions?
The only point to consider is that once we have confirmation that the creditor(s) have written off your debt(s) they will more than likely close that account, but if you do want another credit card in the future there are plenty more credit card companies available to you.
Should I continue using my card?
No. We advise you not to make any further transactions on any credit cards that are being challenged as the lender may argue that you are purposely running up further debt whilst knowing that you are trying to claim compensation. You MUST also continue with the necessary monthly payments while your claim is being processed but there is nothing to stop you from opening another card or loan account with different company.
Will I be able to get another credit card or loan?
Yes, nothing we do in the process will affect your ability to apply for another credit card or loan with a different lender. If you are challenging all of your credit cards but still require such a facility, you should apply for another card from a different provider as soon as possible.
Can I do this if I have bad credit?
Yes definitely! In fact, by doing this you can help yourself to get back on track again. Once we have helped you to clear your debts this will also help to clear your credit file, as the debts will no longer exist.
Will it adversely affect my credit rating?
No, this system will get your debts written off legally and without any adverse affects to your credit rating, in fact it may actually improve it.
Can I do this if I have bad credit?
Yes, in fact, by doing this you can help yourself to get back on track again. Once we have helped you to clear your debts this will also help to clear your credit file, as the debts will no longer exist.
If I owe car finance and my loan is written off will I still be entitled to keep the vehicle?
Yes, if your finance agreement is found to be unenforceable and is written off by our solicitors, you will be entitled to retain any goods you have purchased, including ownership of your vehicle.
Will my Lender threaten me or take me to Court ?
Your lender cannot threaten you because your Credit Agreement will be in formal legal dispute and it is important that any contact or communication you receive from them MUST be directed to the solicitors acting for you otherwise this may jeopardise your claim. Also, it could well be that the solicitors may ultimately take your lender to court, rather then your lender taking you to court!
